Terms of Use – Terms and Conditions

Please review our General Booking, Cancellation, Payment, and other Terms, applicable to a ‘general’ dive center, with care.

  1. Definitions Throughout these terms and conditions, the term “[Your Dive Company]” refers to “the Company,” including its affiliates, officers, agents, employees, workers, directors, and representatives.

  2. General Booking 2.1 All customers are required to provide proof of diving certification from recognized organizations such as PADI, SSI, CMAS, or equivalent certifying bodies. Additionally, a valid logbook must be presented. 2.2 Customers must complete and sign a Liability Release and Assumption of Risk Form. 2.3 The Company does not provide medical advice. If you have any medical concerns related to diving or any other activities, it is essential to consult a certified Medical Practitioner before participating. 2.4 For any diving course registration, regardless of prior experience or training, the Company mandates all students to complete a Medical Questionnaire. 2.5 The maximum diving depth allowed on Company vessels is 30 meters (99 feet) for Open Water Divers with Deep Adventure Dive certification, Advanced Divers, Rescue Divers, Divemasters, and Instructors. Open Water Divers without additional Deep training are limited to 18 meters (59 feet). 2.6 Technical diving depths are governed by the gas mix used and comply with standards from organizations such as the Technical Diving Association. 2.7 The Company reserves the right to modify or cancel diving arrangements due to reasons including, but not limited to, remoteness or inaccessibility of a diving destination, local customs, acts of God, and technical difficulties. No refunds will be provided in such cases. 2.8 Customers or students who do not participate in scheduled dives, for any reason, will not receive refunds for any unused or incomplete portions of the trip or course. 2.9 All cabins are shared unless customers request a private cabin.

  3. Insurance 3.1 Customers are strongly advised to obtain appropriate travel insurance from a reputable provider, covering activities they will undertake. Insurance should encompass Diving, Medical, Travel, Personal Liability, and Cancellation provisions. The Company bears no responsibility for financial or personal losses or injuries when customers opt not to secure such insurance. 3.2 The Company is not liable for loss or damage to luggage or dive equipment while on board the boat or during transfers to or from the boat. 3.3 The Company’s insurance policy covers local emergency evacuations and limited treatment for diving accidents but does not include repatriation, international transportation, or family visitation expenses.

  4. Price and Payment 4.1 A 3% fee is applied to all credit card payments (VISA or Master Card). 4.2 The number of dives in a package is an estimate based on typical diving conditions, not a guarantee. Unforeseen circumstances, like adverse weather, illness, technical issues, remote dive sites, or personal choice, may reduce the estimated number of dives, and no partial refunds will be issued in such cases.

  5. Customer’s Obligations 5.1 Customers causing damage or loss to Company property or equipment due to negligence or irresponsibility are required to reimburse the Company for the current market value of the loss or damage. 5.2 Customers must be physically, emotionally, and mentally prepared and fit for their chosen activities. Any injury or discomfort resulting from unfitness is not grounds for complaint or refund. 5.3 For day trips, the client may prohibit an individual’s participation in diving if they are physically, mentally, or emotionally unfit, fail to respect National Marine Park rules, harm marine life, consume alcohol between dives, or disregard international safe diving standards.

  6. Force Majeure 6.1 The Company reserves the right to modify, delay, or cancel diving arrangements due to remoteness or inaccessibility of the diving destination, local customs, Acts of Nature, war, political unrest, technical difficulties, or other unforeseen circumstances that may render arrangements unsafe or impractical. 6.2 In cases of adverse weather conditions that make landing in a certain port dangerous, the Captain may delay or postpone sailing until safer conditions prevail. This may result in adjustments to the itinerary, potentially leading to the cancellation of specific port visits or a change in the order of island visits.

  7. Cancellation 7.1 The Company will refund all payments made by the customer if the Company cancels a trip or course. However, the Company is not financially responsible for any changes to the itinerary or cancellations resulting from circumstances beyond its control. 7.2 Bank transfer fees will be deducted from the refund in the event of a refund. 7.3 The customer is non-refundable if emergency evacuation requires the boat to return to land. 7.4 A 30% deposit must be paid on the net published selling price of each course or trip to confirm the booking fully. This deposit is non-refundable if the customer cancels less than 24 hours before departure. 7.5 The outstanding 70% must be paid in full before the trip or course starts. If canceled less than 24 hours before departure or if the customer is a no-show, the outstanding amount is non-refundable. 7.6 Cancellations made more than 24 hours before departure do not qualify for a refund on the deposit, but the Company may refund the outstanding 70% if already paid.

  8. Discounts 8.1 Discounts available through the Company and the Client include: 8.1.1 3 days of Day Trip diving on one booking form: 5% discount on the net price 8.1.2 5 days of Day Trip diving on one booking form: 10% discount on the net price 8.1.3 Discounts for Dive Masters and Instructors in teaching status: 10% on the net price 8.1.4 Discounts for returning customers: 5% on the net price 8.2 Only one discount per customer can be applied, and discounts cannot be combined. 8.3 Discounts based on equipment include:

  • Full Set of Equipment: Full Price as per the current price list
  • Mask: 10% discount
  • Fins: 10% discount
  • Wetsuit: 20% discount
  • Regulator: 30% discount
  • BCD: 30% discount
  1. Severability 9.1 If one or more provisions of this agreement are deemed illegal, invalid, or unenforceable, the failure to enforce those provisions will not affect the validity or enforceability of other provisions in the agreement.

  2. Assignment 10.1 The customer may not assign its responsibilities, obligations, or duties under this agreement without written permission from the Company.

  3. Waiver 11.1 The failure to perform one or more obligations under this agreement shall not be considered a waiver of any other obligations in the agreement.

  4. Entire Agreement 12.1 This agreement represents all the rights and obligations of both parties concerning the subject matter. No other arrangements, agreements, or undertakings shall be implied from this agreement.

  5. No Third Parties 13.1 This agreement does not confer rights, either expressly or implicitly, to any third party.

  6. Governing Law 14.1 This contract shall be governed by, construed, and enforced following the laws of the country. Any disputes or issues arising under this agreement will be decided in the courts or tribunals of your country, to the exclusion
